Tower Management Real Estate

Billy Dale Poe has brought suit on behalf of himself and other similarly situated employees against Tower Management Real Estate, L.L.C, Levi Towers, Inc., and Levi Towers II, Inc. Mr. Poe worked as a building monitor and was responsible for duties related to the maintenance of the Levi Towers building. Mr. Poe alleges that Tower Management Real Estate, L.L.C, Levi Towers, Inc., and Levi Towers II, Inc failed to pay him minimum wage and overtime as required by state and federal laws. The employer allegedly compensated Mr. Poe only by providing him with a rent-free apartment, which did not fully compensate him under state and federal minimum wage laws.

What is in This for Me?

Employees are entitled to payment of at least minimum wage for each hour worked and overtime of at least one and one-half times an employee’s regular rate. Tower Management Real Estate is required to pay the difference between the wages actually paid and minimum wage. This will go back three years, because Management Real Estate’s actions are willful. Moreover, wage and hour law allows the amount you are owed to be DOUBLED!

Am I Eligible?

To be eligible for this lawsuit you must:

(1)   Work or have worked as an hourly employee for those companies at any time within the past three years; and

(2)   Did not either receive at least minimum wage of $7.25 an hour or did not receive compensation for overtime of at least one and one-half your hourly rate of pay during your employment with Tower Management Real Estate.

What Time Frame Does This Case Cover?

There is federal Statute of limitations in this case that allows you to recover pay for minimum wage and overtime hours worked within 2 years of signing up by completing a consent form and returning it to use. If we can prove the company willfully violated the law, the statute of limitations may be extended to 3 years.

Do I have to Pay Anything?

You do not have to pay anything to our firm if you join the lawsuit. We are handling this case on a contingency basis. This means we will only be paid if the lawsuit is successful in obtaining relief either through a settlement or a final judgment, and that payment will only come out of that settlement or final judgment.

How Do I Prove I Worked Overtime?

Where the employer does not keep accurate time records, most courts permit the employee to make a good faith estimate of overtime hours. If you feel that you have an overtime claim, you do not need to have proof of the hours you worked and the court will generally accept a good faith estimate of your hours.

How Long Will This Case Take?

The length of a lawsuit varies from case to case. This type of lawsuit typically lasts from one to two years.
